Welcome to LUXHÉLA. These Terms of Service apply when you access or use our website, purchase our products, or otherwise use our services.
By using our website or placing an order, you agree to these Terms of Service. Please read them carefully.
1. About LUXHÉLA
LUXHÉLA is a New Zealand-based personalised lifestyle and gifting brand.
Our products are made-to-order and may be personalised according to information, text, images or other content submitted by the customer.
We use third-party fulfilment and production partners, including Printify, to produce, personalise where applicable, and fulfil orders.
2. Products
We make reasonable efforts to ensure that product descriptions, photographs, specifications and other information displayed on our website are accurate.
However, colours and appearance may vary slightly depending on your device, screen settings, materials, manufacturing processes and other factors.
Because our products are made-to-order, production and availability may vary depending on the product and fulfilment location.
3. Personalisation
Where a product allows personalisation, you are responsible for ensuring that all information you submit is accurate and complete.
This includes, but is not limited to:
* Names
* Spelling
* Dates
* Text
* Photographs
* Images
* Other personalisation information
Please carefully review all personalisation details before placing your order.
Where a product has been correctly produced according to the information submitted by the customer, LUXHÉLA is generally not responsible for customer-submitted errors.
This does not affect any rights you may have under applicable consumer protection laws.
4. Customer Content
If you upload photographs, artwork, text or other content for personalisation, you confirm that you have the necessary rights or permission to use that content.
You must not submit content that:
* infringes another person’s intellectual property rights;
* violates applicable laws;
* contains unlawful or harmful material;
* infringes another person’s privacy or other rights; or
* is otherwise inappropriate for the intended product.
We may refuse or cancel an order where submitted content appears to violate applicable laws or our policies.
You retain ownership of content you submit.
You grant LUXHÉLA a limited, non-exclusive licence to use submitted content only as reasonably necessary to process, produce, fulfil and support your order.
5. Orders
When you place an order, you are making an offer to purchase the selected products.
After placing an order, you will receive an order confirmation. An order confirmation does not necessarily mean that the order has been accepted if there is an issue with payment, pricing, availability, personalisation, fraud prevention, or another material issue.
We reserve the right to cancel or refuse an order where reasonably necessary, subject to applicable consumer law.
If we cancel an order after payment has been taken, we will provide any refund required by applicable law.
6. Pricing
Prices are displayed in New Zealand Dollars (NZD), unless otherwise stated.
Prices may change from time to time.
The price applicable to your order is the price displayed at checkout when you complete your purchase.
Applicable taxes, GST and shipping charges will be displayed or applied as required by applicable law.
7. Payment
Payment must be successfully authorised before an order can be processed.
Payments are processed through the payment methods available at checkout.
We do not directly store complete payment card details. Payment information may be processed by Shopify and relevant payment service providers in accordance with their own terms and privacy policies.
8. Shipping & Delivery
Products are made-to-order and shipped using our fulfilment and shipping partners.
Estimated production and delivery times are provided in our Shipping Policy and at checkout where applicable.
Delivery times are estimates and are not guaranteed dates unless expressly stated otherwise.

9. Returns, Refunds & Consumer Rights
Our Return & Refund Policy explains how we handle returns, refunds, replacements and product issues.
Nothing in these Terms or our Return & Refund Policy excludes, restricts or modifies any rights or remedies you may have under applicable consumer protection laws.
For New Zealand customers, this includes rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
For Australian customers, this includes rights under the Australian Consumer Law where applicable.
10. Intellectual Property
All content on the LUXHÉLA website, including logos, branding, photographs, graphics, text, designs, product images and other materials, is owned by or licensed to LUXHÉLA unless otherwise stated.
You must not reproduce, modify, distribute, sell, publish or commercially exploit our content without our prior written permission, except where permitted by law.

You agree to use our website lawfully and responsibly.
You must not:
* interfere with the operation or security of the website;
* attempt to gain unauthorised access to systems or accounts;
* use the website for fraudulent purposes;

We may use third-party services to operate our business, including Shopify, Printify, payment providers, shipping providers, analytics services and other service providers.

We are not responsible for third-party services to the extent permitted by applicable law.

For New Zealand customers, applicable New Zealand law applies.
Nothing in these Terms prevents a consumer from relying on mandatory consumer protections that apply in their jurisdiction.
